PUBLIC TRUST EASEMENTS ON TIDEWATER LAND

The public trust easement exists upon all coastal land up to the high water mark. State of California v. Superior Court (1981) 29 Cal. 2d 210, 172 Cal. Rptr. 696. The owners of coastal land retain only the bare legal title over the land up to the high water mark; the state controls all of the practical use of this land.
